1.1 These Terms and Conditions govern the use of the Gynect Fitness Network and the associated services that Gynect offers to its members. Gynect operates a fitness network that allows members of partner studios to extend their membership for free.
2. Use of the Platform
2.1 The platform may only be used in accordance with these Terms and Conditions and for lawful purposes.
3. Member Account and Membership
3.1 Creating a member account is required to use Gynect's services. Users must prove their membership in a partner studio to gain access.
4. Using Sports Offers
4.1 Members may use the sports offers of partner studios in accordance with the specific terms of each studio.
5. Usage Rights and Restrictions
5.1 Gynect grants members a non-exclusive, non-transferable right to use the platform. Members may not use the platform for commercial purposes or make it accessible to third parties.
6. Member Obligations
6.1 Members undertake not to misuse the platform and to comply with all applicable laws.
7. Maintenance and Support
7.1 Gynect will make reasonable efforts to provide maintenance and support for the platform and ensure its continuous availability.
8. Platform Availability
8.1 Gynect guarantees platform availability of 99% on an annual average. Planned maintenance work will be announced in advance as far as possible.
9. Membership Fee and Payment Terms
9.1 The use of Gynect is free for members. Costs for additional services of partner studios are to be paid directly to them.
10. Duration, Termination and Suspension
10.1 Membership can be terminated by either party at any time. Members may temporarily suspend their membership, subject to the applicable conditions.
11. Limited Warranty for the Platform
11.1 Gynect guarantees the functionality of the platform within the statutory provisions, but excludes further warranties.
12. Ownership Rights and Member Content
12.1 All rights to the platform and the content provided therein belong to Gynect. Members retain the rights to their own content.
13. Data Privacy
13.1 The protection and processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR).
14. Indemnification
14.1 Members undertake to indemnify Gynect from all third-party claims arising from the member's misuse of the platform.
15. Limitation of Liability
15.1 Gynect shall only be liable for damages caused intentionally or through gross negligence, except in cases of injury to life, body, or health.
16. Right of Withdrawal
16.1 Members have the right to withdraw their membership within 14 days without giving any reason.
17. Entire Agreement and Final Provisions
17.1 These Terms and Conditions constitute the entire agreement between Gynect and the members. Amendments require written form.
18. Applicable Law
18.1 The law of the Federal Republic of Germany applies. For consumers who conclude the contract for a purpose that cannot be attributed predominantly to their commercial or self-employed professional activity, the law of the state in which the consumer has his habitual residence shall apply.
19. Partners
19.1 The cooperation with partner studios is based on separate agreements that govern the use of sports offers by Gynect members.
